UP & BNSF get a Lawsuit.

Also not only did they choose to live there TC but they could have made better decisions in life then to live there. Since they chose to live there they need to shut up and deal with it and there arguments they used such as "It is getting worse because there are more trains than ever." is pathetic and they need to wake up and smell the coffee to realize that the RR's have been working very hard to be cleaner to the environment. Also there is no way BNSF, UP, and Metrolink are violating state and federal regulations when it comes to cleaner emissions for example look at equipment such as the Germsets and older EMD units being rebuilt with ECO powers those reduce emissions and noise levels too. Final Score: Winners BNSF and UP 2 Losers Natural Defense Council 0.
Its too bad that BNSF and UP can't just tell the public at a Press Conference to shut up and deal with it and tell them that they made the decision to live there regardless of the risks, their choices in life, and etc and tell them that when they complain like the way they are in return, they are making themselves look like idiots.
Why aren't these Environmentalists going after the Freeways they bring pollution?

So they should be going after the rails instead since they bring the trains? Don't know about you but I have to smog check my car every other year. How is that not going after the source?

They can't go after freeways since they're government agencies who have immunity. They can't go after car manufacturers since they must comply with EPA standards which they are complying with. They can't go after car owners since there is no way for them to know who the drivers are (just because they have a license plate number doesn't mean they have access to the registration database), they can't sue everyone collectively, and they can't tell whose car is polluting more than others without a smog test (and that's already covered by smog laws and you can't sue someone to force them to comply with auto smog laws). Plus these people filing the lawsuit say they are poor and most likely have old beat-up cars that pollute more than others so basically they will have to sue themselves.

The only entities left are RRs who are just a handful and have deep pockets which I think is the biggest motivation. In bad economic times lawsuits go up by people hoping to make some money. However, RRs are also covered by EPA standards which they must comply with. But that doesn't matter, they are hoping the RRs settle and they all get a big payday.

As far as saying they can just move, these people are poor. They can only afford those areas that are unwanted such as those near industrial areas and they probably have to stay around there since their jobs are nearby and can't afford to travel from the "nicer" areas.

Where I was coming from is that if these people are stupid enough to go after the railroads why aren't they going after the freeways especially in the Elysian Park and Griffith Park areas. Residents are going after Metrolink which I feel is unfair and they are claiming that their trains are noisy and pollute the air around the Taylor Yard area.
